Who's eligible to vote in the election?
Answer: We are organizing the union for primary care physicians across BWH and MGH. According to labor law, though, PCP's who are also managers can't become members of a union. In unclear cases, members will be able to file a challenged ballot until their status is fully determined. Physicians who believe they are eligible are encouraged to vote even if their status hasn't been completely resolved by the time of the election.
Employers will be providing a list of physicians who they believe are eligible to be in the union, as will Doctors Council. The final classification may not become resolved until just before, or even after a union election.
However, a physician who believes they are eligible to vote, but whose name doesn't appear on the official voter list, can still cast their vote under a “challenged ballot.” Clear instructions will be provided in those cases. These ballots remain anonymous and are placed in a special envelope by the NLRB. They’re only opened and counted by the NLRB if they could potentially affect the outcome of the election.
